By accessing and using BrainOff ("the App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

BrainOff is a mobile application designed to help users manage racing thoughts, reduce anxiety, and improve sleep by providing a platform to share and release thoughts.

3. User Accounts

To use certain features, you may be required to create an account. You agree to provide accurate information and maintain the security of your account credentials. You may terminate your account at any time through the in-app account deletion feature. We reserve the right to suspend or terminate your account if you violate these Terms of Use.

4. Privacy

Your actual thoughts are never stored - only metadata (categories, moods, timestamps) is saved. Worry text is processed by AI temporarily and then discarded. See our Privacy Policy for more details.

5. Acceptable Use

You agree not to use BrainOff to:

  • Violate any applicable laws or regulations
  • Transmit any harmful, offensive, or illegal content
  • Attempt to gain unauthorized access to the App
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any commercial purpose without our written consent

6. User Content

You retain ownership of all content you create in BrainOff. By using the App, you understand that your content will be processed by AI services to extract metadata, and the original text is not stored.

7. Third-Party Services

BrainOff uses OpenAI and Firebase services. Your content may be processed by these services in accordance with their respective terms of service and privacy policies.

8. Intellectual Property

The App and its content are owned by BrainOff and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or sell any part of the App without our prior written consent.

AI responses are generated by machine learning models and may not always be accurate or appropriate. We are not responsible for any outcomes resulting from following AI-generated content.

The App is provided "as is" and "as available" without warranties of any kind.

10. Limitation of Liability

To the maximum extent permitted by law, BrainOff and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App.

11. Indemnification

You agree to indemnify and hold harmless BrainOff from any claims, damages, losses, and expenses arising out of your use of the App or violation of these Terms of Use.

12. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. We will notify users of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the App after such modifications constitutes acceptance of the updated terms.
